The salient features of Animal Birth Control (Dogs) Rules, 2001 & Animal Birth Control (Dogs) Amendment Rules, 2010

Govt. of India have framed Animal Birth Control (Dogs) Rules, 2001 in accordance with the powers conferred by Sub section (1) (2) of section 38 of Prevention of Cruelty to Animals Act,1960 (59 of 1960) Animal Birth Control (Dogs) Rules,2001 & ABC (Dogs) Amendment Rules, 2010 are part of carrying out the purpose of PCA Act,1960 (59 of 1960) ABC in Dogs Rules came in to force from 24th Dec-2001 Five amendments in clauses and Rules of ABC (Dogs) Rules,2001 have been made vide ABC (Dogs) Amendment Rules, 2010 wef 08.02.2011. These rules are to be implemented by Local Authority ie Municipal Corporations, Municipalities & Gram Panchayats Regd.District-SPCA @ District level

a. shall monitor implementation of ABC (Dogs) Rules by local Authorities
b. shall guide local Authorities in Implementation of ABC (Dogs).
c. shall give wide publicity and create awareness among Pet Dog owners and to general public on ABC in Dogs Rules, 2001.
d. One member of Regd.District-SPCA will be a member of 8 member monitoring Committee constituted by and at Local authority .

It is the responsibility of the Owners to sterilise and immunise all Pet Dogs owned by them. It is the responsibility of Local Authorities to sterilise and immunise all Stray Dogs available in their jurisdiction. A 8 member Monitoring Committee is to be formed at each Local Authority. among which 3 members should be from local Authority.

a. Ex-Officio Chairman of the Committee @ Commissioner/ Chief of Local Authority – 1 st member
b. One Representative of Public Health Dept of Local Authority
c. One Representative of Animal Welfare Dept of Local Authority ( If any) 3rd member
d. Local Veterinarian – 4th member
e. One Representative of District-SPCA (Preferably DV&AHO ) – 5th member
f. Two Representatives from Animal Welfare Organisations operating within Local Authority Jurisdiction – 6th & 7th member
g. One Humanitarian or experienced in Animal Welfare from within Local Authority Jurisdiction – ( As per ABC (Dogs) Amendment Rules, 2010 )

  1. Term : The term of Monitoring Committee is 3 years
    (Rule -4) ( As per ABC (Dogs) Amendment Rules, 2010 )
  2. Responsibility : of Monitoring Committee is Planning & Management of ABC (Dogs) in Stray Dogs in the Jurisdiction area.
  3. The 8 functions of Monitoring Committee (Rule -5)
  4. Issuing instructions on Catching, transportation, Sheltering, Sterilisation, Vaccination , Treatment & release of sterilised, vaccinated/treated Dogs.
  5. Authorising Veterinarian to decide on need to put sleep (critically ill/Injured/Rabid Dogs) in painless method
  6. Creating Public awareness & Fund raising
  7. Providing guidelines on ABC (Dogs) to Pet Dog Owners & Commercial breeders
  8. Assessing number of stray dogs available in jurisdiction by an Independent agency
  9. Taking steps to monitor Dog Bite cases
  10. Watching national/International research & development on control of Stray Dogs
  11. All activities of Monitoring Committee are to be brought to the notice of public by announcement and advertisements ( As per ABC (Dogs) Amendment Rules, 2010 ) Obligations of local Authority : (Rule -5)

a. Shall provide all facilities for conducting ABC in Dogs
b. Shall be incumbent upon to sterilise and immunise street Dogs with the participation of Animal Welfare Organisations (AWO)registered with AWBI & Pvt individuals
c. Reimbursing Sterilisation & Immunisation expenses to AWO on fortnightly basis
d. Rate of ABC is to be fixed by Monitoring Committee
e. Monitoring Committee shall meet at least once in every month to assess the progress in

ABC in Dogs ( As per ABC (Dogs) Amendment Rules, 2010 )

Capturing : by Humane methods with prior intimation to local people on specified dates and time Sterilisation : a.Healthy Dogs only are to be sterilised under supervision of a Vet b. Sick are to be treated by Recognised Institutions only ( As per ABC (Dogs) Amendment Rules, 2010 ) Immunisation : Sterilised Dogs shall be vaccinated before their release Identification : a. Ears of Sterilised and immunised Dogs be clipped and/or tattooed for identification b. In addition, Dogs may be given token or Nylon collars for ease of identification c. Branding is not permitted Release : a. After Sterilisation, Immunisation and making identification marks, Dogs shall be released at the same place or locality from where they were Captured. b. Release locality, date & shall be recorded Recording : Proper Record of ABC in Dogs shall be maintained by Monitoring Committee/ Local Authority Euthanasia of Street Dogs : permitted for incurably ill and mortally wounded in a humane manner approved by AWBI Furious/Dumb Rabid Dogs : a. Caught & isolated till its natural Death b. Premature killing of suspected is not permitted c. If Rabies is ruled out during isolation, such Dogs are handed over to AWO for rehabilitation Disposal of Carcass : shall be in an Incinerator provided by Local Authority Guidelines to Breeders : a. Registration with SAWB / AWBI is must b. must maintain Record of Births & Deaths c. must maintain Record of Sales and Buyers d. to ensure that Buyer has sufficient knowledge for upkeep of pups before selling to him Existing Rules : if any existing , in any manner, shall prevail, if contains provisions less irksome to animals than ABC (Dogs) Rules.
